Please note that prices quoted are subject to change. Price changes may occur by reason of matters outside our control which increase the cost of the product or service. Factors that may lead to a change of pricing may include adverse currency fluctuations, fuel surcharges, taxes.
In order to confirm Your Booking and price you must make a deposit Payment as per our Payment and Cancellation Terms as outlined below or as otherwise agreed with Us from time to time.
You must make Payment of the balance as per our Payment and Cancellation Terms below.
Where Payment is not made using an accepted Currency, we will convert the monies into an accepted Currency. The rate of exchange will be calculated as at the date of the Booking.
We reserve the right to cancel Your Booking if full Payment is not made in accordance with these General Terms and Conditions.
a) All cruises are subject to weather, tide, and environmental conditions outside of our control. Therefore we reserve the right to continue to the tour, change locations if required or for your safety and comfort cancel due to unsuitable conditions and/or unforeseen circumstances.
b) At certain time of the year dangerous jelly fish inhabit these waters and passengers should take care for their own safety. This is a rare event, however, passengers entering the water do so at their own risk and the operators of the vessel will not be liable for any personal injury, illness, death or any other consequences whatsoever of passengers being stung by jelly fish. To minimise risk you will be provided with a full length protective “Stinger suit” to wear whilst swimming and snorkelling during the cruise.
c) We recommend that you take out travel insurance. Guests should note that adventure travel involves risk. Whilst we make every effort to safeguard guests, we can not be held responsible for any damage, personal injury or loss due to the actions of passengers that are beyond our control.
d) Children are always welcome but must be supervised at all times by a parent /guardian.
e) A certain level of mobility is required to climb on and off the vessel and tenders, due to the nature of the charter wheel do not have wheelchair access
f) Guest cancellation, If you cancel within 24 hours or less notice, the cancellation fee is 100%. 24 hours or more before departure, a full refund applies. Refunds will consist of the ticket price only, exclusive of any credit card fees, booking agents fees or surcharges paid.
g) Operator Cancellations, If Tradewind charters cancels, guests will be refunded their payment in full, inclusive of any fees and surcharges paid.
Please be aware that we have a minimum number threshold in place for all of our trips. Our minimum number threshold is 9 guests. It is very rare that we do not reach this minimum number. We will inform you one month prior to your departure date if there is an issue that may require a charter to be rescheduled.
Without notice, trips may be changed or altered due to but not limited to poor weather conditions, currents, tides, restricted access to custom land.
Deposit is 25% of the total invoice value due at time of Booking
60 days prior to departure: 75% of the total invoice value is due
All payments are non-refundable
Credit card surcharges of 1.9% + .30c per transaction for Visa & Mastercard will apply when paying by credit card. In the event that payment has been made to us by credit card, you agree that you will not seek to chargeback your Payment to us.
Trips fees are non-refundable. However, you can transfer the date of your trip if there is a legitimate reason, and we are notified of the request in writing more than 90 days prior to departure for the trip. Please note that if you cancel or want to move your trip, less than 90 days prior to the day of departure, for any reason at all, you will be liable for the full price of the trip including the transfer costs if applicable. This amount will be payable 90 days prior to the scheduled departure for the trip. It is unlikely that we will be able to fill the vacant position at such short notice, and this is the reason for this policy.
Cancelled bookings will incur charges and these charges can be up to 100% of the cost of the Booking, regardless of whether travel has commenced. Fees and extra charges will apply where a booking is changed. Where we incur any liability for a cancellation fee or charge for any booking which you cancel, you agree to indemnify us for the amount of that fee or charge.
We do not accept any liability of whatever nature, whether in contract, tort or otherwise, for the acts, omissions or default, whether negligent or otherwise, of third-party providers over whom we have no direct control. Under circumstances where liability cannot be excluded, such liability is limited to the value of the purchased travel arrangements. We do not accept any liability in contract, tort or otherwise for any injury, damage, loss (including consequential loss), delay, additional expense or inconvenience caused directly or indirectly by force majeure or any other event which is beyond our control and which is not preventable by reasonable diligence on our part.
You must ensure that you are aware of any health requirements for your travel and ensure that you carry all necessary vaccination documentation. Please check with your local doctor or specialist vaccination clinic. The provision of Activities during Your Holiday is dependent on You being medically fit to participate in the Activities. You are strongly advised to undergo a full medical examination before Your Holiday. We reserve the right to prevent Your participation in any Activities if You are deemed medically unfit to do so or in Our sole discretion, You are not fit to participate in the Activities.
Insurance is strongly recommended for all domestic and overseas travel; this insurance must include medical evacuation cover. If you decline travel insurance, you may be required to sign a disclaimer prior to departing.
